PRIOR TO RELEASE:

Prior to release from BOP/ KROME, the offender may have been processed by an ICE official. Most Cuban and Haitian offenders will have signed an order of deportation and will have been released on an order of supervision. The order of supervision is a release document given by the ICE official with important reporting instructions. It is imperative the offender does not misplace these documents, as it will be needed to obtain a drivers license, social security card, and work authorization card.

All other Cuban/ Haitian/ or other offenders with resident cards, who were not in the custody of BOP/Krome and sentenced to Probation, may have not gone through the deportation process. If the offender falls under this category, he/she will not have been released on an order of supervision and will not be able to apply for a work authorization card. Each case varies as to whether or not the resident card can be renewed. Once the resident card expires, the offender may have a hard time obtaining a new resident card, based on the new conviction. This will cause problems with the renewal of the drivers license and the ability to work legally in the United States. Each case needs to be reviewed by ICE on a case by case basis.

REPORTING UPON RELEASE FROM KROME /BOP:

Offenders released from KROME or BOP, who have signed an order of deportation and were given instructions to report to ICE(Order of Supervision) , can obtain assistance from the U.S. Probation Officer. The offender must report to ICE, at the location listed below, on the date listed on the order of supervision in order to apply for a work authorization card. When reporting to ICE, the deportation officer will place a written notation on the second page of the order of supervision, indicating that the offender has reported as instructed. The offender must abide by the conditions set forth by the Deportation Office. Once reporting has taken place, the offender is to contact the U.S. Probation Officer for assistance with the work authorization card. It is imperative the offender seek the assistance of the U.S. Probation Officer to ensure the application process is completed correctly.

ASSISTANCE WITH WORK PERMITS:

The U.S. Probation Officer can provide assistance to the offender in applying for their work authorization cards for employment. Once the offender has reported to deportation, he/she is eligible to apply. The offender can obtain the appropriate documents needed to file for the work authorization card from the U.S. Probation Officer. Assistance may be provided for indigent offenders who are applying for the initial work authorization card. For all other offenders, the fee for the work authorization card is subject to change; therefore, contact your probation officer. The U.S. Probation Officer will assist the offender with the application process to ensure it is done correctly and to expedite the process. It takes approximately one to two months to obtain the work authorization card, if completed correctly.

*EACH CASE WILL BE REVIEWED ON A CASE BY CASE BASIS, AS EVERYONE'S IMMIGRATION STATUS IS UNIQUE. THE U.S. PROBATION OFFICER WILL BE ABLE TO ASSIST THE OFFENDER UPON COMMENCEMENT OF SUPERVISED RELEASE OR PROBATION.
